The Gujarat High Court today rejected a petition by Doodhsagar dairy Chairman Vipul Chaudhary seeking quashing of a show-cause notice by the Registrar of Cooperative Societies.
The court also imposed fine of Rs 7,500 on Chaudhary for wasting “public time”.
A division bench of Justices K S Zaveri and A G Uraigee said, “It is a luxurious litigation by the applicant, while many poor petitioners do not get time for their litigations.”
Chaudhary, an elected chairman of Mehsana district’s Doodhsagar dairy had challenged the order of a single judge of the High Court.
Justice C L Soni had on February 2 rejected his plea seeking quashing of the show cause notice issued by Registrar M A Naramvala which alleged that he had taken certain illegal actions against the interests of GCMMF.
He was accused of rolling back increase in the price of some commodities. Further, his decision regarding supply of seeds to Maharashtra was illegal, the notice had alleged.
Chaudhary had argued before the High Court that the show cause notice had been issued under political pressure, so that he could not take part in forthcoming election.
Additional Advocate General Prakash Jani had said the notice was perfectly legal.
