Gujarat govt simplifies construction norms, no permission required for up to 125 meter

Gandhinagar: In a significant move to simplify and make hassle-free different kinds of residential and construction work , the Gujarat Government today decided to permit up to 125 square meter of construction work without any prior permission from the authorities, use of single form for seeking permission for construction above this limit and made compulsory for the collector to give no objection certificate (NOC) in connection with any construction in an approved Town Planning area within 30 days.

Addressing a press conference here Deputy Chief Minister (also in-charge of town planning and urban development departments) Nitin Patel today said that to effect it, his department has taken two decision in consultation with Chief Minister Vijay Rupani while the one regarding collector’s NOC has been taken by revenue department led by minister Bhupendrasinh Chudasama.

‘Now for any residential or commercial construction up to 125 square meter in any manner in any town or city area under Municipal Corporation or Municipality or under any other authority by the owner of the land, no prior permission will be needed. An affidavit along with a few related documents including the engineer’s approval to the map, will suffice. In the second decision of urban development department it has been decided to use only one form instead of multiple ones used so far across the state with one uniform rate. The authorities concerned have also been directed to give permission without any undue delay,’ Mr Patel said.

He said that as per the decision of the revenue department now in an approved town planning area, it has been made mandatory for the concerned district collector to give NOC for any construction work after proper investigation within 30 days.

‘The collector will check seven points with regard to any application for NOC including any government or bank due on the land concerned and its nature etc. So far around 700 town planning proposals in the state have been approved. Any one in these localities will get benefit from it,’ the Deputy CM said.

He said that the intention of the government was to make the construction process hassle-free and give relief to the common man.

To a query regarding the regularization process of illegal constructions in urban areas, Mr Patel said that the authorities concerned were flooded with unimaginable number of such applications. ‘The whole process including the related investigations was a time taking procedure that is why the government has extended the time for the process,’ he said.
