Pakistanis create ruckus in JIC Bhuj; Complaint filed

Bhuj: Three Pakistani prisoners allegedly broke earthen pots in custody and spoke abusive words targeting the police staffers while shouting that they didn’t want to stay there, at the Joint Interrogation Centre (JIC) in Bhuj as per a complaint filed in B division police station of district headquarters Bhuj.
The head constable of JIC Kanji Pabubhai Mudhuda filed a complaint against the three accused at B division police station in Bhuj. The accused are booked under IPC sections 186, 427, 294(b) and 114.
The three accused namely Mohammad Sharif Nur Mohammad, Mohammad Ishak Jamil Hussain and Nur Hussain Ayyub Khan had said that for how long they will be kept there and they didn’t want to stay there. The JIC head constable (complainant) had replied to them that they will be released after the government approves emigration.
The three persons got angry and spoke abusive words following which other police staffers also reached the chamber. The three prisoners broke the pots on the table and started beating their heads with the pieces of the broken pots. The police staffers there sent them back to their barrack.
According to a complaint, the accused entered the office of JIC and asked that till how long the would be kept here. They were replied that their order of release would come from the government via immigration department and when such orders arrive, they would be released.  This reply made them further angry and  they said that they don’t want to live here. They started speaking abusive words after this. Three police staffers rushed to the office following this ruckus. When they tried to explain, the accused broke an earthen pot in the office and hit their heads with its pieces. When they were prevented to do that, they again started speaking abusive words. IPC Sections applied in this case:

Section 186 in The Indian Penal Code:
186. Obstructing public servant in discharge of public functions.—Whoever voluntarily obstructs any public servant in the discharge of his public functions, shall be punished with imprisonment of either description for a term which may extend to three months, or with fine which may extend to five hundred rupees, or with both.

Section 427 in The Indian Penal Code:
427. Mischief causing damage to the amount of fifty rupees.—Whoever commits mischief and thereby causes loss or damage to the amount of fifty rupees or upwards, shall be punished with impris­onment of either description for a term which may extend to two years, or with fine, or with both.

Section 294(b) in The Indian Penal Code:
(b) sings, recites or utters any obscene song, ballad or words, in or near any public place, shall be punished with imprisonment of either description for a term which may extend to three months, or with fine, or with both.]

Section 114 in The Indian Penal Code:
114. Abettor present when offence is committed.—Whenever any person, who is absent would be liable to be punished as an abettor, is present when the act or offence for which he would be punishable in consequence of the abetment is committed, he shall be deemed to have committed such act or offence.
