Reservation benefits not applicable to management quota seats: Gujarat HC

Gandhinagar:The bench of judges at Gujarat High Court issued a verdict that the reservation benefits are not applicable in management quota for medical education.

The petitioner had filed a petition in the high court demanding to implement the admission rules in the government quota also for the management and NRI quota for admission in medical education. The single judge at the high court had accepted the demand. However, the state government had stated in the high court that the benefits of reservation can not be given for management quota. The admission rules for general category students in the government quota can not be implemented for management quota for medical admissions, according to the state government. The reservation in-force for the government seats can not be implemented for management quota, as stated by the state government. The bench of judges at Gujarat High Court withdrew the verdict of the single judge.

The petitioner, who belongs to the SEBC category, had got 48.8 % in class 12 and got 392 marks in NEET exam in 2021. He then applied for admission in MBBS. The admission committee gave him admission in a homeopathy college in Surat and told him that at least 50 % is mandatory for medical admission. The state government has made an amendment in 2020 in Gujarat Professional Medical Education Course Rule 2017 that the score of at least 50 % is necessary for admission in medical courses in the government, management and NRI seats. The petitioner had challenged the same in the high court.
