SC dismisses former IPS Kuldeep Sharma’s plea for relief from dept proceedings

New Delhi: The Supreme Court has dismissed a plea of former IPS officer Kuldeep Sharma seeking termination of a departmental probe initiated against him.

Instead the apex court has directed the state government to complete the departmental inquiry against Kuldeep Sharma at the earliest and to allow him the opportunity to raise his objections to the findings before a concerned committee.

The Supreme Court had questioned Sharma for challenging the departmental inquiry after 7 years. According to the court, Sharma must be aware of the law being an IPS officer.

In a case dating back to 2012, the state government had issued a charge memo to former IPS officer Kuldeep Sharma. Sharma had challenged this charge memo before the Central Administrative Tribunal (CAT) after 7 years. This appeal of Sharma was dismissed by CAT and the tribunal’s order was also upheld by the Gujarat High Court.

Sharma had challenged the High Court’s verdict in the matter in the Supreme Court. During this period, Sharma had been issued a show-cause notice and a charge-sheet too had been filed against him. Sharma had allegedly allowed four police personnel to continue as orderlies even after being transferred as managing director at ‘Gujarat Sheep and Wool Development Corporation.’ This post being a civilian post, he had no right to take work from the said police personnel as orderlies.
