HC dismisses PIL by Chamunda Mataji Trust against ropeway at Chotila
May 05, 2023
Chotila: The Gujarat High Court has dismissed a public interest litigation (PIL) filed by the Shree Chamunda Mataji Dungar Trust objecting to the construction of a ropeway on Chotila hill.
The trust had objected to the contract awarded to Mars Entertainment Pvt Ltd, alleging that the government had shown favouritism towards the company. However, the court ruled that since the temple trust had expressed interest in obtaining the contract, its plea cannot be justified as PIL.
The trust and Usha Breco Ltd had previously challenged the government’s decision in 2011, which led to the project being put on hold. However, the government issued a notification on April 5, 2021, awarding the contract to Mars Entertainment once again. The trust’s lawyers also requested an extension of the stay on the construction, but the court rejected the request. DeshGujarat
